LIMITED SERVICE AGENCY RELATIONSHIP: MLS-LISTING.COM is a "Fee For Service" real estate company. Agreeing to & Submitting this Listing Agreement Questionnaire creates a limited service agency relationship between the Seller(s) and MLS-LISTING.COM and Bill Fliflet/Broker as Listing Broker. The limited service agency relationship created consists of providing listing of Seller's property on the real estate agents MLS (Multiple Listing Service), answer general questions from agents about property information not in listing should that occur and/or optional lock box rental. MLS-LISTING.COM nor Bill Fliflet/Broker WILL NOT be representing or advising Seller in any capacity before, during, or after the sale of your property. Seller is advised to acquire professional legal advise before authoring or signing agreements or contracts. If MLS-LISTING.COM or Bill Fliflet/Broker will be acting in the capacity as a hired Seller's Consultant, Selling Broker or Buyers Broker additional agency disclosure(s) will be provided. 7. DRE & MLS RULES: The Seller authorizes MLS-LISTING.COM / Bill Fliflet comply with all applicable Dept of Real Estate & MLS rules and regulations. MLS rules require reporting property status changes of the listing to be updated within 24 hours of accepting an offer and closing of escrow whether the buyer is represented by an agent or not. Seller agrees to notify MLS-LISTING.COM within 24 hours of accepting an offer, closing of escrow, lease or exchange including identity of all parties, price and terms. Seller agrees to pay MLS-LISTING.COM at a rate of $100/day late fee for Seller's failure to report within 24 hours of accepting and offer and closing of escrow. Seller further agrees to be responsible for and promptly pay MLS-LISTING.COM / Bill Fliflet any MLS fines levied as a result of not reporting property status changes or any other violations. Seller agrees MLS-LISTING.COM / Bill Fliflet reserves the right to revoke, cancel or modify listing without notification to Seller if Seller knowingly or unknowingly creates any situation that may violate DRE Department of Real Estate or MLS rules & regulations. Should listing be revoked, canceled or modified for any reason Seller will not receive any refund. Seller(s) waives rights to cause legal action for damages or any other reason against MLS-LISTING.COM / Bill Fliflet should listing be revoked, canceled or modified. 8. HOLD HARMLESS: The Seller agrees by signing this agreement to indemnify, hold harmless, and will defend MLS-LISTING.COM / Bill Fliflet for any allegations of misrepresentations, error or omission, damage, or liability that are caused by the Seller or other agents of the Seller. Seller will pay all legal fees of MLS-LISTING.COM / Bill Fliflet in any action where misrepresentation, error or omission, damage, or liability by Seller or other agent of seller. If suit is brought for collection of any commission or if MLS-LISTING.COM / Bill Fliflet successfully defends any action brought against MLS-LISTING.COM / Bill Fliflet relating to this listing authorization or under any sales agreement relating to listed property, Seller agrees to pay all costs incurred by MLS-LISTING.COM / Bill Fliflet in connection with such action including reasonable attorney's fees and any loss of income. 9. COMPLIMENTARY INTERNET LISTINGS: Seller agrees and acknowledges MLS-LISTING.COM / Bill Fliflet does not have control over Internet companies incorrectly posting or incomplete posting or not posting of your MLS listing or not posting more than one photo. MLS-LISTING.COM nor its representative(s) will not correct or alter any internet listing(s). Seller agrees any internet listing is not guaranteed and holds MLS-LISTING.COM / Bill Fliflet harmless from any misrepresentation, error or omissions, or any damages. 11. DUTIES & FEES: MLS-LISTING.COM / Bill Fliflet agrees to exercise reasonable effort to achieve the purpose of this listing agreement. MLS-LISTING.COM has the right to terminate this agreement after acceptance of an offer. MLS-LISTING.COM listing fee is: $ 275.00 to prepare & input MLS listing & one future listing price reduction if requested in writing. Additional $50.00 per listing change per request received 48 hours after listing verification. MLS-LISTING.COM / Bill Fliflet shall not be responsible for any typographical errors or omissions, property descriptions, photos, internet listings, misinformation or misprints, incorrect seller provided information and shall be held harmless to all. On the occasion that this agreement becomes the subject of litigation for any reason, you agree the venue will be in Chula Vista, CA. Any unpaid fees and or fines are subject to 1.5% per month interest rate (18% annual rate). All Listing, Rental Fees and Deposits are due and are Non Refundable once MLS information is input. Service interruption for non-payment in 3 days. An addition $ 100.00 reconnection fee is required to reinstate. MLS-LISTING.COM provides advertising for MLS-LISTING.COM For Sale By Owner properties on the real estate agents MLS Multiple Listing Service. MLS-LISTING.COM and Bill Fliflet as Listing Broker cannot and will not guarantee there will be any property showings or a sale of seller's property by using this service. Seller(s) warrants that Seller(s) are the owner of the property or have the legal authority to execute this agreement. Seller acknowledges that Seller has read and understands this agreement and retained copy.

Lock Box Rental Agreement
LOCK BOX is repository attached to Seller's property designed to hold property access key(s). A lock box containing your property keys will allow access to the interior of the premises by participants of the MLS, their authorized licensees, and prospective buyers. If the property is not Seller occupied, Seller shall be responsible for obtaining occupants permission for the use of a lock box. LOCK BOX RENTAL FEE & DEPOSIT- The agent style lock boxes (when available) rent for $110 until close of escrow or listing termination + $150 refundable deposit +$18 Standard 2 day delivery & handling. The lock box is ready to install TERMS OF REFUNDABLE DEPOSIT- Once lock box is installed it can only be opened and removed by a licensed agent with a valid MLS lockbox access key pad. It is Sellers responsibility to remove lock box. Generally, agent providing buyer removes lock box. Seller may need to locate & pay an agent to remove lock box if property sells without agent. Seller will receive a lock box deposit refund from MLS-LISTING.COM provided: 1)Seller pays for return shipping to MLS-LISTING.COM. 2)Lock is returned in good working order, good condition and appearance, free from paint, stickers, gouges, etc. 3)Lock Box is received by MLS-LISTING.COM within 3 from escrow closing date or 3 days from listing cancellation or expiration of listing or 3 days from verbal or written notification from MLS-LISTING.COM of revoked or cancelled listing. A LATE FEE of $ 10/day will be charged for Lock Boxes received after the indicated days. ADDITIONAL CHARGE - Not removing lock box from a Seller's property after completing a listing is a violation of MLS rules and regulations. Should the situation occur where MLS_LISTING.COM or an authorized agent is required to remove a lock box from Seller's property, Seller agrees and authorizes to pay MLS-LISTING.COM an additional $200.00 to remove lock box from property. NOTE: We suggest you remove the lockbox from property after acceptance of offer to insure timely return of lockbox.
